HMO/Selective Licence Variation - Application to vary an existing licence

What is this for?

Use this form to apply to make a change to an existing licence relating to either a house in multiple occupation (HMO) or a licensed property in a selective licensing area.

Please Note: Licences are not transferable, a variation cannot be used to transfer a licence to another person. If you are no longer the appropriate person to hold the licence you should make an application to request the existing licence be cancelled/revoked and a new licence application must be made by the proposed new licence holder.

What is it going to cost?

There is no fee for making an application to vary a licence.

If the application is to increase the occupancy of a House in Multiple Occupation by the provision of additional rooms, you may be required to pay an additional room fee prior to the variation being granted. Where applicable, we will contact you to collect any payment due following receipt of your application.

 

What we need from you

The application can only be made by or on behalf of the current licence holder.

The application will require you to give details of the property and the current licence along with what you want to change and why.

If the application is to notify a change to the person managing the property you will also need to make a declaration as to their fit and proper status.

 

What you should expect from us

Where following an application to change a licence, the City Council are considering:

(i)what number of households or persons is appropriate as the maximum number authorised to occupy the HMO to which the licence relates, or

(ii)the standards applicable to occupation by a particular number of households or persons.

Unless legally prescribed standards have changed, the City Council must apply the same standards in relation to the circumstances existing at the time when they are considering whether to vary the licence as were applicable at the time when it was granted.

 

Unless the change is not considered to be material or the City Council do not consider it appropriate to do so,  before varying a licence, the City Council must:

(a)give details of the proposed change to the licence holder and each relevant person, and

(b)consider any representations made.

 

Where an application is refused, before refusing to vary a licence, the City Council must:

(a)give details of the reasons for the refusal to the licence holder and each relevant person, and

(b)consider any representations made.

 

Once the City Council have made a decision to allow or refuse a variation, within 7 days of making the decision, they will give details of the decision to the licence holder and each relevant person setting out:

(i)the reasons for the decision and the date on which it was made,

(ii)the right of appeal against the decision, and

(iii)the period within which an appeal may be made.

 

More information

Where a licence is varied at the request of the current licence holder, the change will take effect as soon as the City Council have made the decision to grant the variation.
