Members of the public who wish to submit a representation in regards to a Premises Licence or Club Premises Certificate application need to be aware their personal details will be made available to the applicant.  If this is an issue they may contact a local representative such as a ward, parish or town Councillor or any other locally recognised body such as a residents association about submitting the representation.

The Council is not able to accept anonymous representations. Representations must include your full name, address and contact information (telephone number, email address).

‘Relevant representations’ are representations:

  • about the likely effect of the premises licence on the promotion of the licensing objectives;
  • which have not been withdrawn and are not, in the opinion of the Council, frivolous or vexatious.

The four licensing objectives are:

  • The prevention of crime and disorder
  • Public safety
  • The prevention of public nuisance
  • The protection of children from harm

Any issues which fall outside of the licensing objectives will not be considered relevant.

For example:

A person wants to use a premises to open a convenience store selling groceries, newspapers and general household items. They would also like to be able to sell alcohol so they apply for the appropriate licence.

During the consultation period, a nearby resident objects to the application stating ‘’the premises are on a busy road and the opening of a new shop will increase the amount of traffic passing my property which will mean it takes me longer to get my car off my driveway’’.

This is not a relevant representation because traffic is not a licensing objective and even if the licence application was refused, the premises could still operate as a convenience store any potential increase in traffic would happen regardless of whether or not the premises was licensed for the sale of alcohol.

It is for delegated officers of the licensing authority to determine whether a representation is frivolous or vexatious.

Where relevant representations are received about an application the authority will hold a hearing to consider them unless the authority, the applicant and everyone who has made representations agree that the hearing is not necessary.

Staff Training and Awareness:All staff will receive regular training on how to identify and handle potentially criminal or disruptive behavior, including dealing with intoxicated individuals, theft, and any other form of anti-social conduct.Staff will be trained to operate the premises in accordance with all licensing conditions, ensuring full compliance with local regulations.

The cameras coverage will include the front and back door areas.

CCTV footage at this premises will be kept for a period of 31 days and access to the system/footage will be provided to police officers upon request subject to the Date Protection regulations and the Information Commissioner Guidance on CCTV as may from time to time have effect.

A staff member, trained in the use of the CCTV system, will be in attendance at the premises at all times that licensable activities take place and be able to fully operate the system to be able to download in a recognised format any information requested by the Police, Police employees and all responsible authorities.

The premises will operate a "Challenge 25" Proof of age policy

Signage will be displayed at the area where alcohol/cigarettes/other age restricted goods and located for sale within the premises and also by the till point's confirming the "Challenge 25" Policy is in force and advising that it is illegal to purchase products on behalf of underage customers.

The only acceptable forms of identification allowed will be a valid passport, valid photo ID driving licence, UK armed forces military ID or valid proof of age card with the pass approved hologram.

There will be electronic point of sale system which automatically prompts the till operator to verify age of customer wherever alcohol is sold.

Hard copies of the refusal records must be produced for the inspection by any responsible authority when licensable activity is taking place.

Staff will receive relevant training, which will include the sale of age-restricted goods and acceptable forms of proof of age ID.

Refresher training will be provided at 6 monthly intervals.

b) The prevention of crime and disorder

A digital CCTV system will be installed, or the existing system maintained, such system to be fit for the purpose.

The CCTV system shall be capable of producing immediate copies on site. Copies of recordings will either be recorded digitally on to CD/DVD or other equivalent medium.

Any recording will be retained and stored in a suitable and secure manner for a minimum of 31 days and shall be made available, subject to compliance with Data Protection legislation, to the police for inspection on request.

The precise positions of the camera may be agreed, subject to compliance with Data Protection legislation, with the police from time to time.

The system will display, on any recording, the correct time and date of the recording.

The CCTV system will be maintained and fully operational throughout the hours that the premises are open for any licensable activity.

An incident book/register shall be maintained to record:

- all incidents of crime and disorder occurring at the premises

 - details of occasions when the police are called to the premises

This book/register shall be available for inspection by a police officer or other authorised officer on request.

c) Public safety

There will at all times be adequate levels of staff maintained at the premises. Such  staff levels will be disclosed, on request, to the licensing authority and police.

d) The prevention of public nuisance

Adequate waste receptacles for use by customers shall be provided in and immediately outside the premises.

Notices shall be prominently displayed at all exits requesting patrons to respect the needs of local residents and businesses and leave the area quietly.

e) The protection of children from harm

The premises licence holder will ensure that an age verification policy will apply to the premises whereby all cashiers will be trained to ask any customer attempting to purchase alcohol, who appears to be under the age of 25 years (or older if the  licence holder so elects) to produce, before being sold alcohol, identification being a  passport or photocard driving licence bearing a holographic mark or other form of  identification that complies with any mandatory condition that may apply to this  licence.

Signage informing customers of the age verification policy adopted at the premises will be prominently displayed.

All staff engaged or to be engaged in the sale of alcohol on the premises shall receive training in age restricted sales. Induction training must be completed and documented prior to the sale of alcohol by the staff member. Refresher/reinforcement training must be completed and documented at intervals of no more than 6 months. Training records will be available for inspection by a police officer or other authorised officer on request.

All cashiers shall be trained to record refusals of sales of alcohol in a refusals book/register. The book/register will contain:

The Challenge 25 scheme must operate including a refusals log, signage and the maintenance of staff training records.

A CCTV system to the specification of South Yorkshire Police will be fitted, maintained and in use at all times whilst the premises are open. The CCTV images will be stored for 30 days, police and authorised officers of the council will be given access to images for purposes in connection with the prevention and detection of crime and disorder. Members of the management team will be trained in the use of the system.

It is considered that for the nature of the operation door supervisors will not be required however, a risk assessment will be undertaken should unusual events takes place and if they consider it appropriate will employ the same. Where engaged, door staff shall be licensed by the SIA.

The premises will maintain a register of refusals and incidents. Such records will be kept and made available for inspection of the authorities Staff will receive training on matters concerning underage sales, drugs policies, and operating procedures

including evacuation procedures Records of such training will be kept and made available for inspection of the authorities

Regular checks of all bottle bins inside the premises, this is to check for signs of substance use from discarded drug paraphernalia. The bottle bins will be checked by glass collectors at the end of each night the premises is open.

Regular toilet checks to be made by security supervisors. These visits will be recorded on a checklist located inside each of the toilets which will give the time and offered making the visit. Door supervisors will carry out toilet inspections every 30 minutes.

Any incidents involving violence, criminal damage, injury or harm to an individual, or ejections from the premises, must be recorded in either an incident book or in an electronic incident log by the end of that trading day. The incident book is to be kept at the premises and the book or electronic incident log made available for inspection by an officer of a Responsible Authority, including Police and Local Authority officers

In making this application we have borne in mind the provisions of the Licensing Act 2003, the s182 Guidance and the current Doncaster Metropolitan Borough Council Statement of Licensing Policy.

 

  1. CCTV will be provided in the form of a recordable system, capable of providing pictures of EVIDENTIAL QUALITY in all lighting conditions particularly regarding facial recognition.
  2. Cameras shall encompass all ingress and egress to the premises, fire exits, outside areas, and all areas where the sale/ supply of alcohol occurs.
  3. Equipment must be maintained in good working order, be correctly time and date stamped, recordings MUST be kept in date order, numbered sequentially and kept for a period of 31 days.
  4. The Premises Licence Holder must ensure at all times a DPS or appointed member of staff is capable and competent at downloading CCTV footage in recordable media format, and able to produce it to a Police Officer and/or an authorised Local Authority/Council Trading Standards Officer on demand and in a viewable format.
  5. The CCTV equipment shall be kept in a secure environment under the control of the DPS or other responsible named individual.
  6. An operational weekly log report must be maintained endorsed by signature, indicating the system has been checked and is compliant, in the event of any failings actions taken are to be recorded.
  7. In the event of technical failure of the CCTV equipment the Premises Licence holder/DPS must report the failure to the Police (on contact number ‘101’) and Council Licensing Department immediately.
  1. An incident log must be kept at the premises. Incident log records will be retained for a period of 12 months from the date it occurred. It will be made immediately available on request to an ‘authorised person’ (as defined by Section 13 of the Licensing Act 2003), an authorised Trading Standards Officer or the Police, and must record the following:
    • all crimes reported to the premises (where relevant to the licensing objectives)
    • all ejections of patrons
    • any complaints received (where relevant to the licensing objectives)
    • any incidents of disorder
    • any refusal of the sale of alcohol
    • any visit by a relevant authority or emergency services, noting time, date & purpose and those officials by name.
  1. The Premises shall maintain active membership and participation in any Business Crime Initiative supported by South Yorkshire Police covering the locality whilst such a scheme shall be in existence. Active membership means attendance at 75% of any and all Watch Meetings per annum, and participation includes any Radio Link scheme similarly supported by the local Crime and Safety Partnership.
  2. The Premises Licence Holder shall have a procedure in place to ensure that they Exit is checked regularly and clear of obstructions at all times.
  3. The staff will ensure that the customer area will be free of trip hazards and spillages at all times.
  4. Noise or vibration shall not emanate from the premises so as to cause a nuisance.
  5. If the general public congregating outside the premises are causing anti-social behaviour, the management shall request that they leave, and if the problem persists the Police shall be called to support.
  6. Prominent, clear and legible signage (in not less than 32 font bold) shall be displayed at all exits to the premises requesting the public to respect the needs of local residents and to leave the premises quietly.
  7. The premises shall operate a Challenge 25 Policy. Such policy shall be written down and kept at the premises. The policy shall be produced on demand of the Police or an ‘authorised person’ (as defined by Section 13 of the Licensing Act 2003) or an authorised Trading Standards Officer the Local Authority/Council. Prominent, clear and legible signage (in not less than 32 font bold) shall also be displayed at all entrances to the premises as well as at, at least one location behind any counter advertising the scheme operated.
  8. A written register of Refusals will be kept including a description of the people who have been unable to provide required identification to prove their age. Such records shall be kept for a period of 12 months and will be collected by the Designated Premises Supervisor and produced to the police or an ‘authorised person’ (as defined by Section 13 of the Licensing Act 2003) or an authorised Trading Standards Officer the Local Authority/Council on demand.
  9. All staff engaged in the sale of alcohol to be trained in responsible alcohol retailing to the minimum standard of BIIAB level 1 or any equivalent training course within 1 month of commencing employment at the premises. No person shall be authorised to sell or supply alcohol until this training is completed. Refresher training will be conducted at 12 monthly intervals. Training records shall be kept on the premises and produced to the police or an ‘authorised person’ (as defined by Section 13 of the Licensing Act 2003) or an authorised Trading Standards Officer of the Local Authority/Council on demand.
  1. A challenge 25 age verification scheme will operate at the premises whereby any person who appears to be under 25 years of age, and unknown to the staff member serving as a person over 18 years of age, shall not be served alcohol unless they provide identification to prove they are over 18 years of age.
  2. Acceptable forms of identification will be a valid passport, a valid photo ID driving license or a valid proof of age scheme card with the PASS approved hologram.
  3. Appropriate signage advertising the operation of the Challenge 25 scheme must be displayed in the vicinity of all points of sale for alcohol.
  4. All people involved in the delivery of alcohol, be this the premises licence holder/designated premises supervisor, employees or third-party courier, shall at the point of delivery be satisfied that the person to whom the alcohol is being delivered is 18 years or over.
  5. If, at any point of the process, acceptable photographic age verification documents cannot be produced on request, the delivery shall be refused, and alcohol returned to the licensed premises
  6. Deliveries shall only be made to the address indicated on the order.
  7. The delivery may not be left unattended or in a safe space for later collection and must be received, in person, by a person satisfying the Challenge 25 criteria. Where no recipient is available, the alcohol part of any order must be returned to the premises and a record made in the Refusal Log.
  8. Deliveries shall only to be made to bona fide business/commercial addresses or private residences and not to any public/open spaces (e.g. car parks, street corners, bus stops, public parks).
  9. Deliveries shall be refused to any person who is, or who appears, to be under the influence of alcohol or drugs and the alcohol shall be returned to the licensed premises.
  10. The licence holder/designated premises supervisor shall ensure that only the alcohol items specified on orders processed for despatch are loaded onto delivery vehicles, and no alcohol surplus stock shall be carried on vehicles.
  11. Where third-party couriers are used to provide the delivery of orders containing alcohol, the premises licence holder/designated premises supervisor shall have a contractual arrangement with each third party to be satisfied that the promotion of the licensing objectives and terms of the premises licence are complied with at all times, with particular attention to the point of delivery.
  12. The premises licence holder/designated premises supervisor shall keep records of or have access to all alcohol orders. For each order containing alcohol, records shall include:
    • the name and address of who made the order
    • age verification at the point of order
    • any refusals made at the point of order
    • the items ordered
    • the date and time of the dispatch
    • details of the delivery provider/driver
    • the date and time of delivery
    • the full postal delivery address
    • the name of the person receiving the order
    • detail of identification/proof of age documents received
    • details of any refusals at the point of delivery including reasons.
  1. Records shall be retained at the licensed premises for a period of 12 months and be produced on request for inspection by a police officer or an authorised person of the licensing authority.

We will engage with a third party to manage our fire safety, from training staff on egress of the building, and working on compliance of fire equipment, to providing suitable risk assessments.

Frequent waste collections will ensure no foul smells for local residents. Also noise from the premises will be monitored closely to ensure that it does not cause nuisance to neighbours.

  1. e) The protection of children from harm

A high level of staff training will ensure that no harm, physical or moral, is brought to minors, including but not limited to the implementation of the 'challenge 21' scheme.
